PART – I

A COMPREHENSIVE REPORT ON RIGHT TO INFORMATION AND OBLIGATIONS OF PUBLIC AUTHORITIES AS REQUIRED UNDER SECTION 4[1][b]OF RIGHT TO INFORMATION ACT- 2005.

Office of the Development Commissioner, Noida Special Economic Zone, Noida.
 

I. 

The particulars of its organization, functions and duties;

1. a)

Approval of Project Applications to set up new units in NSEZ as well as EOUs in nine Indian states including verification / site inspection|

        b)

Conversion of DTA unit into EOU / SEZ units into EPCG

Security wing of NSEZ responsible for all security matters of the NSEZ Complex and to help Customs wing in vigilance and other activities. Also regulates inward and outward movement of goods and patrolling of Zone area day and night.

Labour section of the office have been taking care of all the labour related issues of the zone units and workers. Also working as local labour office and to ensure follow‑up of policies under relevant labour laws. Also set up a Labour Court for proceedings under Payment of Wages Act, Gratuity Act, Payment of Bonus Act etc.. Registration under Factories Act, Shops & Establishments Act, Contract Labour Act. Conciliation process under Industrial Disputes Act.

II.

The powers and duties of its officers and employees

 

Projects to set up new units are considered by Unit approval Committee headed by Development Commissioner/Joint Development Commissioner. All proposals requiring decision are cleared at the level of Development Commissioner. In the absence of Development Commissioner, the same are approved at the level of Joint Development Commissioner.

III.

The procedure followed in the decision making process, including channels of supervision and accountability

 

All the papers are received at Reception Counter and after inwarding the same is sent to DC / JDC. From them it comes to the Section through concerned DDC / ADC. After examination in Section, the same again goes to JDC / DC for decision through concerned DDC / ADC.

Project applications are examined on file. Deficiencies, in application if any, are brought to the notice of the applicant for rectification and then the same is discussed in UAC meeting, which is held on every working Tuesday at 11.00 AM. UAC comprises of DC, JDC, DDC, DC(Customs), Asstt. Commissioner Trade Tax Deptt., UP, Asstt. Engineer UPPCB, Ex. Engineer, SDO, UPPCL and Associate Architect Noida Bldg. Cell. Based on recommendations of the Committee, Promoter of the unit is called for discussion on the Project in next meeting and based on such discussion, decision to approve / disapprove the project is taken.

Once project is approved, the same day promoter can apply for Plot / SDF in NSEZ and the same is allotted to him within 03 days on lease rent basis for 15 / 05 years respectively. He is required to pay quarterly advance rent and Bank Guarantee equivalent to one year’s rent. Once requisite advance rent and B.G. is received, Promoter of the unit is handed over the possession (Both on paper and physical) of plot / SDF.

After having possession of space, unit may submit Legal Undertaking on Rs.100/- non-judicial stamp paper, application for FCMC, Importer-Exporter Code, Electricity connection, NOC / consent from UPPCB, Registration with Trade Tax Deptt., Building Plan, B-17 Bond with NSEZ Customs.
